Privacy Policy

1. Parties

This privacy policy belongs to Femtomax Inc. ("Femtomax," "Femtoplay," "we," or "our") and covers the Femtoplay platform. The policy explains how the company collects, uses, maintains, and discloses information from customers, website visitors, and sometimes visitors to customer websites ("Users"). Undefined capitalized terms are defined in the Terms of Service.

2. Purpose

Internet business operations require information collection from Users. The policy covers all methods of gathering both personally-identifiable information ("PI") and anonymous information ("AI"), collectively called "Information." Data provided to the company is not necessarily treated as private.

3. Acceptance of the Policy

Users accept this policy by visiting www.femtoplay.com, using the mobile application, using the media player, ordering Services, or joining the email list.

4. Changes to Policy

Material policy changes will be communicated via email, website notice, or Privacy Policy flag updates. Users who disagree with changes may request removal of their PI by contacting the company, though legally required data will be retained.

5. Information Collection and Use

Generally

The company may use PI as required by law, including in response to legal process or law enforcement requests. Information sent to the company is not considered confidential and may be shared with any individual or entity.

Information in Customer Records

Customers provide names, addresses, phone numbers, usernames, credit/debit card information, and bank details. The company may acquire additional information from third parties like credit reporting agencies and collects usage data, creating "Registration and Billing Information."

User Inquiries

Contact information is collected to resolve questions and assist with business operations ("User Inquiry Information").

Anonymous Information

The company does not collect anonymous information about website or mobile app visitors.

Third Party Agents

Third parties assisting with Services, hosting, payments, fulfillment, and promotions must agree in writing to maintain privacy protections equivalent to this policy.

Unrelated Third Party Links

The site contains links to third-party websites for which the company is not responsible. Third-party privacy policies may differ from this one.

Customer Inquiries Use

Customer inquiry information identifies Users and is used throughout the business to provide services and market new offerings. Information is shared with third parties to identify and fix Service problems, and third parties must keep it confidential.

Children's Information

The company does not knowingly collect personally identifiable information from children under 13. Parents or guardians should contact the company if a child has provided such information.

Except for lawful public authority requests, personal information is only shared with Femtoplay agents or subcontractors for stated purposes. Policy changes will include notice and opt-out opportunities.

6. Access and Modification of PI

Users may request access, updates, and corrections by contacting the company. Users can modify information through their account control panel or request deletion by contacting the company.

7. Deletion and Retention of PI

Account closure and PI deletion can be requested through the mobile app, with deletion attempted accordingly. The company may retain PI as required by law for regulatory compliance, typically limited to financial transaction and contact data. Account closure takes up to 60 days to reconcile transactions, with no refunds issued after closure.

8. Security

The company has implemented technical, physical, and administrative safeguards to protect PI against loss and unauthorized access or disclosure. Personal information retention processes maintain data as necessary for stated purposes or legal requirements. Employees must keep information confidential.

California Privacy Rights

California residents may request a list of all third parties receiving their personal information for direct marketing purposes. The company will provide:

  1. Categories of information disclosed to third parties for direct marketing during the preceding year
  2. Names, addresses, and examples of businesses that received such information

Requests should be submitted in writing via postal mail or email using contact information provided on the Contact page. The company does not currently respond to "do-not-track" requests since it does not employ tracking methods.

HIPAA

HIPAA (The Health Insurance Portability And Accountability Act) does not apply to Femtoplay's services. The company is not a "Covered Entity" or "Business Associate" under HIPAA definitions. Services do not meet HIPAA standards, so users should not submit, store, or disclose HIPAA-subject information expecting compliance.

Testimonials

Per the Terms of Service, users may provide endorsements for Services promotion. With use of endorsements, the company may utilize the user's first name, last initial, home state, voice, likeness, and contact information. Users may request discontinuation by contacting the company, with cessation occurring soon after processing.
